Watson Laboratories sued by Teva Women's Health over generic Cenestin ANDA

Watson Pharmaceuticals, Inc. today confirmed that its subsidiary, Watson Laboratories, Inc., a Nevada Corporation, has been sued by Teva Women's Health, Inc., in connection with the filing of Watson's Abbreviated New Drug Application (ANDA) for synthetic conjugated estrogens, A, in the 0.3 mg, 0.45 mg, 0.625 mg, 0.9 mg and 1.25 mg tablet strengths. Watson's ANDA is for the generic equivalent of Teva's Cenestin®. The suit was filed on April 23, 2010, in the United States District Court for the District of New Jersey.

Court of Appeals denies McNeil Pediatrics' CONCERTA patent appeal

The Court of Appeals for the Federal Circuit has denied an appeal by McNeil Pediatrics, a division of Ortho-McNeil-Janssen Pharmaceuticals, Inc., to overturn a 2009 decision by the U.S. District Court of Delaware that the patent for CONCERTA (methylphenidate HCl) Extended-Release Tablets CII is invalid and not infringed by Andrx Corporation.

New Jersey District Court jury finds Nycomed's U.S. Patent No. 4,758,579 not invalid: Teva

Teva Pharmaceutical Industries Ltd. announced today that a jury returned a verdict in the U.S. District Court for the District of New Jersey finding that Nycomed's U.S. Patent No. 4,758,579 is not invalid. The Court has reserved decision on the issue of what, if any, effect to give to the jury's determinations in connection with the obviousness-type double patenting defenses, which Teva has argued is to be decided by the Court.

FDA grants tentative approval for Sagent Pharmaceuticals' adenosine injection

Sagent Pharmaceuticals, Inc., a privately held specialty pharmaceutical company, today announced that the U.S. Food and Drug Administration had granted tentative approval of adenosine injection, USP, the generic equivalent of Astellas Pharmaceuticals' Adenoscan®, in 60 mg per 20 mL and 90 mg per 30 mL vials. IMS data indicate that the 2009 U.S. innovator market for these adenosine presentations approximated $124 million. The Company plans to launch the product upon expiry of applicable innovator patents.

Court finds Novamont patents to be valid

The Court found two Novamont patents to be fully valid and a third patent to be partially invalid while also finding that Novamont had not provided proof of the infringement. Not entering into the merit of the case, the Court noted that the analyses on samples of the products of the summoned companies had not been conducted in a two-party process.

Epix Pharmaceuticals' MRI imaging intellectual properties to be auctioned on May 28, 2010

Joseph F. Finn, Jr., C.P.A., Assignee for the Benefit of Creditors of Epix Pharmaceuticals, Inc., announced today that the MRI imaging intellectual properties will be auctioned on May 28, 2010. The assets of Epix were transferred to him on July 20, 2009 and he is liquidating them for the benefit of Epix creditors.
