Exclusive licensing practices slows innovation in gene testing market

Exclusive licenses to gene patents, most of which are held by academic institutions and based on taxpayer-funded research, do more to block competition in the gene testing market than to spur the development of new technologies for gauging disease risk, say researchers at the Duke Institute for Genome Sciences & Policy (IGSP).

POZEN enters Settlement Agreement with Teva over generic Treximet ANDA patent infringement litigation

POZEN Inc., today announced that it has entered into a Settlement Agreement with Teva Pharmaceuticals USA, Inc. (Teva) to resolve a U.S. patent infringement suit related to Teva's filing of an Abbreviated New Drug Application (ANDA) with the U.S. Food and Drug Administration (FDA) to market a generic version of Treximet® (sumatriptan/naproxen sodium) marketed by POZEN's exclusive U.S. licensee, GlaxoSmithKline.

Epix Pharmaceuticals' MRI imaging intellectual properties to be auctioned on May 28, 2010

Joseph F. Finn, Jr., C.P.A., Assignee for the Benefit of Creditors of Epix Pharmaceuticals, Inc. ("Epix"), announced today that the MRI imaging intellectual properties will be auctioned on May 28, 2010. The assets of Epix were transferred to him on July 20, 2009 and he is liquidating them for the benefit of Epix creditors. He recently reached an agreement with Bayer Schering Pharma that permits the sale of the MRI imaging programs.

USPTO issues patent for Taro Pharmaceutical Industries' T2007

Taro Pharmaceutical Industries Ltd. announced that the U.S. Patent and Trademark Office has issued United States Patent No. 7,683,071 covering T2007. The patent, entitled "Composition and method for improved bioavailability and enhanced brain delivery of 5,5-diphenyl barbituric acid," is for one of a class of non-sedating barbiturate compounds currently in development by the Company.

Par Pharmaceutical, sanofi-aventis resolve patent litigation case

Invalidation of gene patents will benefit patients

Dr. Jim Evans, an expert in gene patenting and genetics policy who has led a program to educate federal judges about the intricacies of genetics and genetic policy, says the ruling by United States District Court Judge Robert Sweet that invalidated seven patents related to the BRCA 1 and BRCA 2 genes "came as a surprise to everybody. It's really quite unusual for plaintiffs to get a summary judgment."
